Representing Consumers in Bankruptcy and Debt Collection Cases

Debt Litigation

If you are sued or threatened suit by a debt collector, it is often difficult to know what to do.  Nevertheless, the worst thing of all that you can do is ignore the case completely.

Debt Collection Defense

Debt buyers and collection agencies frequently take advantage of people who are too afraid to stand up for their rights.  If you receive notice that you are being sued over unpaid debt, you must take it seriously and you must not delay in dealing with the problem.  Hiring an attorney to represent you can be expensive, but you need an advocate. We will pursue every option available to you under the law, and fight to ensure that you have to pay no more than what you legally owe.

Unfair Debt Collection

Both the federal Fair Debt Collection Practices Act (FDCPA) and California’s Rosenthal Act promote ethical business practices by debt collectors, restrict abusive collection acts, and provide specific rights for consumers. Nevertheless, debt collectors continue to use unfair and illegal collection practices. If you are being unfairly harassed by collection agencies, or if they have lied to you in attempting to collect a debt, you may have a right not just to stop the harassment, but to turn the tables and sue them.

False Credit Reporting

The credit reporting agencies treat information about you like their inventory.  Nevertheless, most credit reports contain errors. When the agencies don't fix those errors, you may be denied a job, a mortgage, a tenant’s lease, or other forms of credit.  The federal Fair Credit Reporting Act (FCRA) requires that these companies delete inaccurate information. If they fail to do so, and if you are harmed in any way, the FCRA also gives you a right to sue these companies to redress the harm that you have suffered.
